If, on the same network, you can receive the same kind of file from other person, be sure it's a problem between your clients communication (DCC stands for Direct Client to Client, and there might be problems on you connecting directly to the other computer ). that's made automatically by mIRC [either by asking you with a dialog box, or just doing it automatically, depending on your settings).
Falcon, maybe it's just the other client who is unable to send the DCC to you, for any reason? (that message could come for many IRC clients which don't really have a window for DCC transfers, but you have to issue a '/dcc accept '.
